Tanzania Establishes Capital Markets Tribunal to Resolve Disputes and Protect Investors

The Tanzanian government has established the Capital Markets Tribunal to resolve disputes in the securities market, protect investors, and enhance financial market integrity.

The Tanzanian government has launched the Capital Markets Tribunal (CMT), aimed at resolving disputes within the securities market, safeguarding investor interests, and promoting transparency.

The tribunal is chaired by a High Court judge and supported by four members with expertise in capital markets. It holds the full judicial powers of the High Court.

The establishment of the tribunal is expected to provide legal clarity and protection, ensuring a stable investment environment as Tanzania’s securities market has faced challenges that necessitate a mechanism for resolving disputes and protecting investors.

The Capital Markets Tribunal seeks to address these issues by offering a transparent platform for resolving grievances related to securities regulations, stock market activities, and other related concerns.

Speaking during the ongoing Law Week in Dodoma, Martin Kolikoli, the Registrar of the Capital Markets Tribunal, explained that the tribunal is pivotal to achieving the goals of the National Development Vision 2050.

“The tribunal will manage claim rights, protect investors, and foster good governance, contributing to sustainable economic and social development,” said Kolikoli.

He also highlighted the tribunal’s role in ensuring fairness and transparency in the stock market. Educational campaigns will be launched to inform investors and the public about capital markets and the tribunal’s processes. Digital platforms for filing claims and tracking case progress will also be introduced.

The tribunal is also collaborating with similar institutions in Canada and South Africa to build capacity and enhance its operational effectiveness. Over the next two years, the tribunal aims to become a leading authority in securities market appeals across Sub-Saharan Africa, fostering trust and integrity within the region’s financial markets.

The launch of the tribunal comes as Tanzania’s stock market shows solid growth. The Dar es Salaam Stock Exchange (DSE) recorded a 22.23% growth in 2024, placing it among Africa’s top-performing stock markets.
